(1) Traffic Directorate History & Organisation:
- Traffic Directorate was established in the year-1985 vide Government order Dated 09-04-1985 under a DIG rank officer.
- The post of Director traffic was upgraded in the year 1997 and I G Rank officer was made in charge and thereafter in the year 2006 again upgraded and Addl. DG Rank officer was made in charge of this unit.
- The Post of Inspector General of Police Traffic, U.P. was created in the year 2010 vide Govt. of India Notification 11052/13/2010-AIS-II-A, Dt. 30-03-2010.
- The post of Dy. Director, Traffic in the SP rank was created with the posts of assisting staff at the Directorate level in the year 1987.
(2) Objective :
- Traffic directorate was established with the objective to ensure better traffic management, recommend and adopt various road safety measures in the state. This directorate was also expected to coordinate with the government for effective implementation of its different action programmes and to coordinate with the field staff through I/C of Distts Police.
- The directorate is also entrusted with the task of guiding and monitoring all the activities related to enforcement road safety, training and organizing programmes to inculcate better traffic sense amongst the people & to bring necessary and desired improvement.
- Director Traffic has been nominated as nodal officer for Uttar Pradesh for collecting, compiling, analysing and furnishing information about road accidents in the prescribed proforma to Ministry of road transport and highways in connection with the U.N.ESCAP programme on Asian Pacific Road Accident Data Base (APRAD) and Asian Pacific Road Accident Data base( I.R.A.D.) to formulate strategy for the reduction in road accidents.
- Directorate is also entrusted with the task of identifying accident prone areas and suggesting measures to reduce road accidents and mortality rate.
- Responsibilities to ensure effective patrolling on highways and providing cranes and ambulance etc.for Traffic Aid Centres established on various highways of different distts were also given to the Directorate.
- Launching special drive for effective implementation of traffic rules and regulations and their proper monitoring is also an important duty given to this directorate.
- Task to inculcate better traffic sense among students, N.C.C. cadets, drivers of private and commercial vehicles by organising specialised road safety, training programmes.
- Task of maintaining “Uttar Pradesh Police Traffic management fund Rule 2008” as per rules and ensuring its proper utilisation.
- Inspect work of traffic police lines and all activities related to traffic management in the distt. to maintain high standard of efficiency.
- Purchase and provide various types of equipments to the districts for better traffic management and to install mandatory, cautionary and informative road signs where it is otherwise not possible by the concerned department/authority in the interest of public safety to reduce accidents and mortality rate .
- Establishment related work of Non Gazetted staff.
- Selecting Traffic Inspectors amongst Coy. Commdrs. of P.A.C. and sending them for specialised training..
- Selecting Traffic Sub Inspectors amongst S.I.A.P./ Platoon Commdrs. of P.A.C. for basic and specialised training and their postings.
- Selecting Hd.Const. Traffic Police/ Const. Traffic Police amongst HCAP and Const. A.P. through Range IsG/ DIsG for training and posting as Head Constables Traffic Police and Constables Traffic Police as per vacancies.
- Presenting work assessment report of Supdt. Of Police/Addl.Supdt. of Police/Deputy Supdt. Of Police to the Director Genl. Of Police and other concerned officer before acceptance of their annual remarks.
- To look into complaints against gazetted and non-gazetted staff of Traffic Police and ensure proper necessary actions in them.

- Selecting Traffic Inspectors, Traffic Sub Inspectors, Head Constables Traffic Police and Constables Traffic Police amongst Coy.comdr ./Platoon comdr / S.I.A.P./ HC AP/ Const. AP for training and posting as Traffic sub inspectors, Head constables Traffic Police /Constables Traffic Police in various districts as per vacancies.
- Making indepth study, analysing and adopting various road safety measures and issuing necessary directions in this regards to all concerned for effective implementations.
- Purchasing equipments required for road safety ,enforcement work ,training and supplying to all concerned subsequently.
- Effective monitoring of highways patrolling and “traffic aid centers” established on the highways for controlling and preventing accidents. Sending datas of road accidents to Govt. of India in prescribed proforma for formulating policies and taking decision accordingly .
- Enforcing traffic rules ,regulations and legal provisions of M.V.Act strictly by effectively launching special drives time to time.
- Ensuring proper utilisation of “shaman shulk” (compounding charges) as per rules.
- Making people aware about the road safety measures and various provisions of law, rules and regulations by organising training and various other programmes.
- Organising traffic week/month at the district / state level .

- Imparting training and providing information about traffic rules and regulations to students(boys/girls)/N.C.C.Cadets/Traffic wardens/driver of commercial and private vehicles.
- Imparting road safety education in different school and colleges of the state to students and teachers.
- Organizing quiz programmes and film shows about road safety, different kinds of races/painting competitions for school children and various other programmes for college students ,teachers and general public.
- Enrolling and training traffic wardens.
- Distributing callendors, pamphlets and other relevant literature about road safety amongst public and different sections of society including school and college through I/C of Distt. Police.
- Publicising road safety measures through T.V.,Radio, various news papers and magazines widely.Road safety fillers on F.M. Radio city channel have become a big hit.
- Providing necessary useful informations to the departmental personnel and general public through web site of Traffic Directorate

(II) Traffic directorate is collecting ,compiling ,maintaining and transmitting information quarterly in prescribed proforma successfully to Ministry of Road transport and highways about road accident data for the purpose of ESCAPS, an U.N. project on Asian Pacific Road accident data base(APRAD) and Indian road accident data base(IRAD). Objective of this study is to formulate a strategy for the reduction in road accident and to analyse them for taking remedial measures.. India was specifically selected for the aforesaid project keeping in view of its inherent diversities.

(C) Uttar Pradesh Motor Vehicle Rules, 1998
Uttar Pradesh Motor Vehicle Rules, 1995 was amended & in its place replaced by Uttar Pradesh Motor Vehicle Rules, 1998.
(D) Necessity of helmet and legal provisions:--
Two wheelers are responsible for 16% road accidents in U.P. because it is not very stable vehicle. Wearing helmet for two wheeler driver is necessary as it saves head region of driver and its pillio rider during dangerous fall or slip or accident.
LEGAL PROVISIONS
CENTRAL MOTOR VEHICLES ACT,1988
129-Wearing of protective headgear.- Every person driving or riding(otherwise than in a side car on a motor cycle of any class or description)shall while in a public place, wear (protective headgear conforming to the standards of Bureau of Indian Standards)
Provided that the provisions of this section shall not apply to a person who is a sikh if he is while driving or riding on the motor cycle in a public place wearing a turban;
Provided further that the State Government may by such rules provide for such exceptions as it may think fit.
Explanation—Protective headgear” means a helmet which,--
(a) by virtue of it’s shape ,material and construction could reasonably be expected to afford to the person driving or riding on a motor cycle a degree of protection from injury in the event of an accident and
(b) is securely fastened to the head of the wearer by means of straps or other fastenings provided on the headgear.
Corresponding Law of S.85-A of M.V Act 1939
Objects and Reasons:-Clause 129 empowers the State Government to prescribed protective headgear to be worn by the drivers or pillion riders of motor cycle other than a person who is a Sikh wearing a turban and to make such exemption as the State Government thinks fit.
Notes on clauses
Substituted by section 38 of Bill no 53 of 1994 seeks to amend Section 129 to make the wearing of protective headgear conforming to the standards of Bureau of Indian Standards Obligatory.
UTTAR PRADESH MOTOR VEHICLES RULES 1998
201. Protective headgear-Wearing of- (1) Every person while driving or riding a motor cycle, a scooter or moped shall wear a protective headgear conforming to the specification given in sub-rule (2) below .
(2)Each protective headgear shall
(i) be of specifications of Bureau of Indian Standards
(ii) be permanently and legibly labelled in such manner that level or levels can be
read easily without removing padding or any other permanent material description
such as-
(a) manufacturer’s name of identification
(b)size;
(c) month and year of manufacture; and
(d) the mark of the Bureau if Indian Standards
(iii) have minimum three adhesive type retro reflective red colour strips of the size of 2 centimeter multiplied by 15 centimeter affixed horizontally on back of the headgear which will illuminate during the night;
Providing that sub rule (1) of this rule shall not apply to-
(a) every pillion rider of a motor cycle, scooter or a moped
(b) any [person wearing a turban while driving a motor cycle, scooter or a moped in a public place,
Explamation- for the purposes of this rule turban means cloth 6 meter by 82 centimeter which any person while driving a motor cycle, scooter or moped in a public place may tie as such around his head.
(E) Legal provision of seat belt:-
Wearing seat belt for the occupants of motor vehicle other than motor cycle/three wheeler of engine capacity not exceeding 500 c.c. and having provisions for seat belt is necessary for the safety from road accidents.
LEGAL PROVISIONS
CENTRAL MOTOR VEHICLES RULES 1989
125- Safety belt, collapsible steering, column auto dipper and padded dash boards (1)One year from the date of commencement of the Central Motor Vehicles (Amendment) Rules 1993, the manufacturer of every motor vehicle other than motor cycles and three wheelers of engine capacity not exceeding 500 cc. shall equip every such vehicle with a seat belt for the driver and for the person occupying the front seat.
(1-A) The manufacturer of every motor vehicle of M-1 category shall equip every motor vehicle with a seat belt for a person occupying the front facing rear seat.
Sub-R (1-A) Substitute by G.S.R. 400( E) dated 31.5.2002 (w.e.f. 31.5.2002.).Before its substitution, sub-R.(1-A) read as underL1-A) The manufacturer of every motor vehicle other than heavy passenger vehicle motor cycles and three wheelers shall equip such vehicle with a seat belt for the person occupying the rear seat.
Provided that the specifications of safety Belt Assemblies and Safety .Belt Anchorages in motor vehicles shall conform to AIS; 005-2000and AIS;015-2000
Specifications, respectively as may be amended from time to time ;till such time as corresponding Bureau of Indian Standards specifications are notified.
Provided further that on and after Ist October,2002,the specification of Safety Belt Assemblies and Safety Belt Anchorages in motor vehicles shall conform toAIS005-2000 and AIS:015-2000 specifications ,respectively)
(5)Inserted by G.S.R.400(E),dated 31.5.2002. On and after Ist January 2003,the size and specifications on seats ,their Anchorages and Head Restraints(excluding luggage retention)on –M-I vehicles category shall conform to AIS:016-2000 specifications ,as may be amended from time to time ,till such times corresponding Bureau of Indian Standards specifications are notified.

125-A Safety belt etc. for construction equipment vehicles One year from the date of commencement of the Central Motor Vehicles (Sixth Amendment) Rules 2000 the manufacturer of every construction equipment vehicle other than an agriculture tractor shall equip every such vehicle with a seat belt for the driver and for the person occupying the front seat and with rear view mirror.

Section 138. Signals and additional safety measures for (motor vehicle)
Sub section (3) In a motor vehicle in which seat belts have been provided under sub rule (1)or sub rule (1-A)of rule 125 or rule 125-A as the case may be it shall be ensured that the driver and the person seated in the front seat or the persons occupying front facing rear seats as the case may be wear the seat belts while the vehicle is in motion.
(F) Provisions for parking handicapped persons:-
1. Identifying and reserving 5% of available space in parking places for the handicapped persons in all the parking.
2. Making rectangles on the surface of parking areas in the size of a motor vehicles.
3. Making a strip at the distance of 3 feet from the parking rectangle to avoid parking of any other vehicle in between and making possible accessibility of wheel chair to the vehicle.
4. A wheel chair shall be painted in the rectangle as per instructions and reserved for handicapped shall be written on it .
5. No. charges shall be taken from the handicapped.
6. Only persons having medical certificate provided by chief medical officer are eligible for this parking.
7. Aforesaid certificate may be shown/hanged on the rear view mirror after lamination during parking.
8. Strict action shall be taken against the persons/vehicle occupying handicapped parking illegally by using crane , clamping wheel and challaning vehicle
9. Contract shall be cancelled if some contractor is allowing parking of other vehicles on the reserved area for the handicapped vehicles.
